Aerial Pics Consortium does not charge a fee to process Payment Transactions. The financial institution that issues the Customer’s financial instrument may charge a fee in connection with the debiting or charging of the Purchase Amount to the financial instrument as a result of a Payment Transaction. Customers should consult the terms and conditions governing their financial instruments or contact the financial institutions issuing their financial instruments for more information about such fees (if any).
These Terms and Conditions for Payments do not amend or otherwise modify the Customer’s agreement with the issuer of his/her financial instrument, payment instrument or redeemable instrument, and the Customer is responsible for ensuring that his/her use of the payment services complies with such agreements.
The acceptance of Customer financial instruments by Aerial Pics Consortium to purchase products or services does not constitute approval from or is not offered in conjunction with the issuer of the Customer’s financial instrument. The issuer of the Customer’s financial instrument may impose fees, transaction limits, or other limitations on transactions incurred with Aerial Pics Consortium Inc.
Aerial Pics Consortium Inc. may delay, hold, cancel or reverse processing of any transaction if Aerial Pics Consortium Inc., in its sole discretion, believes that the transaction is invalid, suspicious, involves misconduct or fraud, or otherwise violates Applicable Law, these Terms and Conditions for Payment, or any applicable Aerial Pics Consortium Inc. policies.
If a Customer has an inquiry regarding a Payment Transaction or believes there has been an error or unauthorized transaction regarding a Payment Transaction, the Customer may contact Aerial Pics Consortium at 754-200-8441 or by emailing Aerial Pics Consortium Inc. at: firstname.lastname@example.org.
If Aerial Pics Consortium Inc. is holding funds due to the Customer arising from a Payment Transaction processed using any service described herein, and Aerial Pics Consortium is unable to contact the Customer and has no record of Customer’s use of the service for several years, Applicable Law may require Aerial Pics Consortium Inc. to report these funds as unclaimed property. If this occurs, Aerial Pics will try to locate the Customer at the address shown in Aerial Pics Consortium records, but if Aerial Pics Consortium Inc. is unable to locate the Customer, it may be required to deliver any such funds to the applicable state authority as unclaimed property. Aerial Pics Consortium Inc. reserves the right to deduct a dormancy fee or other administrative charges from such unclaimed funds, as permitted by Applicable Law.
Aerial Pics Consortium Inc. may establish general practices and limits concerning transactions, including without limitation, individual or aggregate transaction limits on the dollar amount or number of transactions during any specified time period. Aerial Pics Consortium Inc. reserves the right to modify, change, suspend or discontinue any product or service at any time, including hours of operation or availability of the product or services or any service feature, without notice and without liability. Aerial Pics Consortium Inc. also reserves the right to impose limits on certain service features or restrict access to some or all of the services without notice and without liability. We may decline to process any transaction without prior notice to you.
Aerial Pics Consortium Inc. may limit or suspend the Customer’s use of one or more services at any time, in Aerial Pics Consortium Inc. sole and absolute discretion. If Aerial Pics Consortium Inc. suspends the Customer’s use of a service, we will attempt to notify the Customer by electronic mail to the email address provided by the Customer. Suspension of Customer’s use of a service will not affect the Customer’s rights and obligations pursuant to these Terms and Conditions of Payments arising before or after such suspension or with respect to any non-terminated services.
Aerial Pics Consortium Inc. reserves the right, in its sole and absolute discretion, to change, modify, or amend any portion of these Terms and Conditions of Payments at any time by posting notification here or otherwise communicating the notification to the Customer. The changes will become effective, and shall be deemed accepted by the Customer, after the initial posting and shall apply on a going-forward basis with respect to transactions initiated after the posting date. In the event that the Customer does not agree with any such modification, the Customer’s sole and exclusive remedy is to terminate the use of these services.
The failure of Aerial Pics Consortium Inc. to exercise or enforce any right or provision of these Terms and Conditions for Payments shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions for Payments shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions for Payments shall otherwise remain in full force and effect and remain enforceable between the parties. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. These Terms and Conditions for Payments constitute the entire agreement between the Customer and Aerial Pics Consortium Inc. with respect to Payment Transactions. These Terms and Conditions for Payments are not intended and shall not be construed to create any rights or remedies in any parties other than the Customer and Aerial Pics Consortium Inc.
Aerial Pics Consortium Inc.’s failure to insist upon or enforce performance of any provision contained in these Terms and Conditions of Payments shall not ever be understood, interpreted or construed as a waiver of any provision or right. Aerial Pics Consortium Inc. reserves the right to assign the rights and duties contained in this agreement to any party at any time without any obligation of notice to the Customer.
