Aerial Pics Consortium Inc. Terms and Conditions for Payments

Customers must review these Terms and Conditions for Payments before they decide whether to accept them and continue with the registration and/or purchase of products and/or services offered by Aerial Pics Consortium Inc. These Terms and Conditions for Payments are a legally binding agreement, between the customer and Aerial Pics Consortium Inc. The “Customer” is hereby defined as any individual or entity entering into a payment transaction with Aerial Pics Consortium Inc., whether said transaction is made via www.apicsworld.com, via phone, via email or by any other means of communication between the Customer and Aerial Pics Consortium Inc. A “Payment Transaction” is hereby defined as the processing of a payment resulting in the debiting, charging or otherwise withdrawing of the purchase amount, made to a Customer’s credit or debit card, PayPal account, or any other financial instrument accepted by Aerial Pics Consortium Inc. as a form of payment, for the purchase of products and/or services provided by Aerial Pics Consortium Inc. to the Customer. A “Purchase Amount” is hereby defined as the total dollar amount set to pay for a product or service offered by Aerial Pics Consortium Inc., including any and all related fees, taxes, shipping charges, or any other additional fees or charges that may be applicable. Financial instruments may refer, without limitation, to credit or debit cards, checking or saving accounts that are ACH-enabled, accepted gift cards, any other prepaid payment methods, and/or other financial accounts registered in a Payment Transaction made by the Customer. Customers wanting to purchase products or services from Aerial Pics Consortium Inc. need to be aware that not all financial instruments available are eligible for use to complete Payment Transactions through www.apicsworld.com or via phone, email or by any other means of communication between the Customer and Aerial Pics Consortium Inc. By agreeing to Terms and Conditions for Payments, Customers represent the following:
  • Customer is 18 years of age or older; and
  • Customer is capable of entering into a legally binding agreement.
If Customer is a business entity, said Customer also represents that:
  • The Customer is duly authorized to do business in the country or countries where Customer operates; and
  • The individual executing the purchase, whether an employee, officer, representative or agent is duly authorized by the entity to enter into a Payment Transaction and therefore is duly authorized to legally bind the entity to these Terms and Conditions for Payments; and that all transactions conducted under the Customer’s username and password and/or using the Customer’s financial instrument to complete the Payment Transaction are duly authorized by the entity.
By agreeing to these Terms and Conditions for Payment, the Customer authorizes Aerial Pics Consortium Inc. to charge the Customer’s financial instrument when Customer incurs transactions or fees for the purchase of any of the products or services offered by Aerial Pics Consortium Inc. All Payment Transactions made between the Customer and Aerial Consortium Inc. are subject to the following conditions.
Aerial Pics Consortium Inc. accepts the following financial instruments to complete transactions, whether through www.apicsworld.com, via phone, email or any other means of communication between Customer and Aerial Pics Consortium Inc.:
  • MasterCard
  • Visa
  • Pay Pal
When a Customer completes a Payment Transaction, the Purchase Amount will be deducted from the Customer’s financial instrument in the official currency of the United Stated of America: the US Dollar.
Due to the way transactions are processed by external banking sites, there may be delays of 1-3 days in updating a payment made by a Customer in Aerial Pics Consortium Inc. records.
All funds resulting from Payment Transactions will be deposited in Aerial Pics Consortium Inc. bank account.
Payment Transactions are secure:
  • Online payment Transactions will be processed directly by the Merchant Gateway or PayPal using Secure Socket Layer (SSL) technology.
  • Payment information (such as credit, debit or account numbers) is protected with a high level of encryption when transmitted over the Internet.
  • Aerial Pics Consortium Inc. does not have access to the Customer’s financial instrument information. Aerial Pics Consortium Inc. may have access to some information, such as type of payment and last four (4) digits of the Customer’s credit, debit or account number, for the sole purpose of assisting the Customer in identifying the form of payment used to complete a given Payment Transaction; should the Customer contact Aerial Pics Consortium Inc. to discuss said given Payment Transaction and the payment information is required to satisfy the Customer’s request or inquiry.
Payment Confirmation:
  • If a Payment Transaction is successful, the Customer will be notified, via email that the payment was completed and received by Aerial Pics Consortium Inc. Payment confirmations will be sent to the email address provided by the Customer during the check-out process or established in the Customer’s permanent personal account (if set up by Customer).
  • If a Payment Transaction is unsuccessful, the Customer will be advised via email that the payment has failed. Notification of payment failure will be made in the same way set forth for successful payment confirmations. Aerial Pics Consortium Inc. will not be advised why a payment has failed; therefore, the Customer should contact the issuer of the financial instrument directly for details on failed transactions.
  • If the Customer’s payment fails, the Customer may use other accepted financial instruments to complete the Payment Transaction.
  • Aerial Pics Consortium Inc. will confirm the details of the payment to the Customer via email, as set forth on Paragraph 6 – “Confirmation” – of this Terms and Conditions for Payments.
By using any of the payment options offered by Aerial Pics Consortium Inc., Customers agree to all applicable Aerial Pics Consortium Inc. policies relating to Payment Transactions.
All information provided by the Customer during the Payment Transaction process will be handled in accordance with Aerial Pics Consortium Inc.’s Privacy Policy.
Aerial Pics Consortium Inc.’s Terms and Conditions for Payments are subject to change at any time. Each Payment Transaction shall be subject to the specific Terms and Conditions for Payments that were in place at the date and time the Payment Transaction occurred. The accepted date and time of Payment Transaction will be the date and time registered on Aerial Pics Consortium Inc. records.
Setting-Up a Permanent Customer Account: Customers may choose to register for a permanent customer account (hereinafter referred to as the “Permanent Customer Account”) by creating a profile through www.apicsworld.com, or contacting Aerial Pics Consortium Inc. via phone, email or by any other means of communication. To open a Permanent Customer Account, Customers will be asked to provide information such as their name, phone number, email address, physical address, and other contact information. Aerial Pics Consortium Inc. may verify the Customer’s registration information with a third party verification vendor.
For the Customer’s convenience and the celerity of Payment Transactions, Customers may associate a financial instrument to their Permanent Customer Accounts. In the event the Customer decides to associate a financial instrument to their Permanent Customer Account, specific financial instrument information will be required. Required financial instrument information may include, without limitation, name of financial institution issuing the instrument, account numbers, routing numbers, expiration dates, security codes and any other necessary information (if and as applicable). In some cases, Aerial Pics Consortium Inc. may ask the Customer to provide additional information, such as a copy of a valid ID, or to answer additional security questions to help Aerial Pics Consortium Inc. verify the Customer’s identity and right to use said financial instrument. Aerial Pics Consortium will not have ANY ACCESS to the financial instrument information stored on the Costumer’s Permanent Customer Account. Said information will be kept encrypted and confidential.
Customers are solely responsible for:
  1. maintaining the confidentiality of the username and password created to open and access the Permanent Customer Account and the associated financial instrument information,
  2. any and all Payment Transactions or use by persons to whom the Customer has given access or that otherwise use such username or password, and
  3. any and all consequences of use or misuse of the Customer’s username and password. Customer agrees to notify Aerial Pics Consortium Inc. immediately of any unauthorized use of the Customer’s username or password or any other breach of security regarding the services of which the Customer may have knowledge. If a Customer believes his/her Permanent Customer Account and the associated financial instrument have been opened or used in an unauthorized manner, the Customer should contact Aerial Pics Consortium Inc. immediately to report said unauthorized use.
If the Customer is a business entity, the Customer agrees that all officers, employees, agents, representatives and others having access to the username and password shall be vested by the Customer with the authority to use the Permanent Customer Account, including, without limitation, the use of the financial instrument associated to the account or the use of any other service; and that said use legally binds the business entity serving in this case as the Customer. The Customer shall be responsible for all actions by current and former officers, employees, agents, representatives and others, regardless of whether authorized by the Customer, that access the services using the entity’s user name and password.
Customers are solely responsible for providing accurate registration and/or financial instrument information and for updating and maintaining the accuracy of the Permanent Customer Account and the financial instrument information. Customers are solely responsible for notifying Aerial Pics Consortium Inc. of any changes to their Permanent Customer Account or financial instrument information that are not possible to be made online directly by the Customer.
Customers authorize Aerial Pics Consortium Inc. to confirm that all financial instrument used by the Customer are in good standing with the issuing financial institution. Aerial Pics Consortium Inc. may submit a request for a payment authorization and/or a low dollar credit and/or debit to the financial Instrument for verification. Aerial Pics Consortium Inc., in its sole and absolute discretion, may refuse to approve or may terminate existing Permanent Customer Accounts and the associated financial instruments with or without cause or notice, other than any notice required by any Applicable Law, and not waived herein.
  1. All information provided by the Customer will be used by Aerial Pics Consortium Inc. to determine if the Customer is eligible to either open and/or maintain a Permanent Customer Account, associate a financial instrument and/or to continue using or consuming products or services provided by Aerial Pics Consortium Inc. Provision and use of all personal data provided by the Customer is subject to Aerial Pics Consortium Inc.’s Privacy Policy.
Customer agrees to immediately notify Aerial Pics Consortium Inc. of any unauthorized use of the Permanent Customer Account, the Customer’s financial instrument, or any other breach of security of which Customer has knowledge.
Aerial Pics Consortium may restrict Customer access to his/her Permanent Customer Account, temporarily or permanently if Aerial Pics Consortium Inc. notices suspicious activity in said account. Aerial Pics Consortium Inc. will not be liable for restricting access to the Customer’s Permanent Customer Account because of suspected suspicious activity.
The Customer is solely responsible for reviewing statements and transaction activity to determine if there are any errors or unauthorized transactions charged to their financial instrument, and for alerting Aerial Pics Consortium Inc. of such events. It is the Customer’s obligation to save or print a copy all Payment Transactions made between the Customer and Aerial Pics Consortium Inc. If Customer access to Permanent Customer Account is canceled or terminated by any reason, by either the Customer or Aerial Pics Consortium Inc., Customer will not be permitted to access statements or transaction activity stored by Aerial Pics Consortium Inc.

Aerial Pics Consortium does not charge a fee to process Payment Transactions. The financial institution that issues the Customer’s financial instrument may charge a fee in connection with the debiting or charging of the Purchase Amount to the financial instrument as a result of a Payment Transaction. Customers should consult the terms and conditions governing their financial instruments or contact the financial institutions issuing their financial instruments for more information about such fees (if any).

These Terms and Conditions for Payments do not amend or otherwise modify the Customer’s agreement with the issuer of his/her financial instrument, payment instrument or redeemable instrument, and the Customer is responsible for ensuring that his/her use of the payment services complies with such agreements.

The acceptance of Customer financial instruments by Aerial Pics Consortium to purchase products or services does not constitute approval from or is not offered in conjunction with the issuer of the Customer’s financial instrument. The issuer of the Customer’s financial instrument may impose fees, transaction limits, or other limitations on transactions incurred with Aerial Pics Consortium Inc.

Aerial Pics Consortium Inc. may delay, hold, cancel or reverse processing of any transaction if Aerial Pics Consortium Inc., in its sole discretion, believes that the transaction is invalid, suspicious, involves misconduct or fraud, or otherwise violates Applicable Law, these Terms and Conditions for Payment, or any applicable Aerial Pics Consortium Inc. policies.

If a Customer has an inquiry regarding a Payment Transaction or believes there has been an error or unauthorized transaction regarding a Payment Transaction, the Customer may contact Aerial Pics Consortium at 754-200-8441 or by emailing Aerial Pics Consortium Inc. at: customer.service@apicsworld.com.

If Aerial Pics Consortium Inc. is holding funds due to the Customer arising from a Payment Transaction processed using any service described herein, and Aerial Pics Consortium is unable to contact the Customer and has no record of Customer’s use of the service for several years, Applicable Law may require Aerial Pics Consortium Inc. to report these funds as unclaimed property. If this occurs, Aerial Pics will try to locate the Customer at the address shown in Aerial Pics Consortium records, but if Aerial Pics Consortium Inc. is unable to locate the Customer, it may be required to deliver any such funds to the applicable state authority as unclaimed property. Aerial Pics Consortium Inc. reserves the right to deduct a dormancy fee or other administrative charges from such unclaimed funds, as permitted by Applicable Law.


Aerial Pics Consortium Inc. may establish general practices and limits concerning transactions, including without limitation, individual or aggregate transaction limits on the dollar amount or number of transactions during any specified time period. Aerial Pics Consortium Inc. reserves the right to modify, change, suspend or discontinue any product or service at any time, including hours of operation or availability of the product or services or any service feature, without notice and without liability. Aerial Pics Consortium Inc. also reserves the right to impose limits on certain service features or restrict access to some or all of the services without notice and without liability. We may decline to process any transaction without prior notice to you.

Aerial Pics Consortium Inc. may limit or suspend the Customer’s use of one or more services at any time, in Aerial Pics Consortium Inc. sole and absolute discretion. If Aerial Pics Consortium Inc. suspends the Customer’s use of a service, we will attempt to notify the Customer by electronic mail to the email address provided by the Customer. Suspension of Customer’s use of a service will not affect the Customer’s rights and obligations pursuant to these Terms and Conditions of Payments arising before or after such suspension or with respect to any non-terminated services.


Aerial Pics Consortium Inc. reserves the right, in its sole and absolute discretion, to change, modify, or amend any portion of these Terms and Conditions of Payments at any time by posting notification here or otherwise communicating the notification to the Customer. The changes will become effective, and shall be deemed accepted by the Customer, after the initial posting and shall apply on a going-forward basis with respect to transactions initiated after the posting date. In the event that the Customer does not agree with any such modification, the Customer’s sole and exclusive remedy is to terminate the use of these services.

The failure of Aerial Pics Consortium Inc. to exercise or enforce any right or provision of these Terms and Conditions for Payments shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions for Payments shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions for Payments shall otherwise remain in full force and effect and remain enforceable between the parties. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. These Terms and Conditions for Payments constitute the entire agreement between the Customer and Aerial Pics Consortium Inc. with respect to Payment Transactions. These Terms and Conditions for Payments are not intended and shall not be construed to create any rights or remedies in any parties other than the Customer and Aerial Pics Consortium Inc.


All Payment Transactions executed between the Customer and Aerial Pics Consortium Inc. are ruled by and abide to the laws, regulations and provisions of the State of Florida in the United States of America, and shall be governed in all respects by said laws, regulations and provisions only, without regard to choice of laws or provisions of any other jurisdiction or ruling instance. Any claim, cause of action, dispute, legal proceeding and/or mediation resulting or arising – directly or indirectly – from a Payment Transaction shall be resolved in the state or federal courts of the state of Florida in the United States of America and must be commenced within one (1) year after said claim, cause of action, dispute, legal proceeding and/or mediation arises.


Aerial Pics Consortium Inc.’s failure to insist upon or enforce performance of any provision contained in these Terms and Conditions of Payments shall not ever be understood, interpreted or construed as a waiver of any provision or right. Aerial Pics Consortium Inc. reserves the right to assign the rights and duties contained in this agreement to any party at any time without any obligation of notice to the Customer.
